1. Scope and Relationship with Terms & Conditions

This Refund Policy forms an integral part of the Tissy Ltd Terms and Conditions. By entering into a contract with Tissy Ltd, the Client confirms that they have read, understood, and agreed to this Refund Policy in full.

In the event of any inconsistency between this Refund Policy and the Terms and Conditions, the Terms and Conditions shall prevail.

2. Nature of Services Provided

Tissy Ltd operates strictly as a bespoke installation service provider and does not sell standard or off-the-shelf products.

All services, including but not limited to:

aluminium fences,
aluminium flooring,
railingsystems
epoxy and metallic art floor coatings,

are carried out exclusively on the basis of custom-designed projects agreed in advance with the Client.

3. Project Approval and Custom Manufacturing

3.1 Prior to commencement of production, the Client will be provided with:

samples (where applicable),
technical specifications,

3.2 Production of materials shall only commence after written approval of all drawings and specifications by the Client.

3.3 Once approved and sent to the factory, all materials are:

custom-manufactured specifically for the Client,
non-returnable,
non-refundable,
non-transferable.

4. Production and Installation Timeline

4.1 The production period for aluminium and related materials typically ranges between 4 to 6 weeks, depending on complexity and supplier availability.

4.2 Any stated timelines are estimates unless expressly confirmed in writing as binding.

5. Payment Structure

5.1 Upon signing the contract, the Client is required to pay a non-refundable deposit of 30%–50% of the total contract value.

5.2 The remaining 50%–70% balance must be paid within no more than 7 calendar days following project completion and the snagging process.

5.3 Failure to make final payment within the agreed timeframe constitutes a breach of contract.

6. Epoxy and Metallic Art Flooring Disclaimer

6.1 Metallic Art Epoxy Floor Coatings are hand-applied artistic finishes, created through live mixing and application of materials directly on site.

6.2 Due to the nature of this process:

final colour tones,
patterns,
effects and flow,

may differ from drawings, samples, or visual representations provided prior to installation.

6.3 Such variations are inherent characteristics of the product and do not constitute defects, non-conformity, or grounds for refunds, provided the work is completed professionally and in accordance with industry standards.

7. Refund Eligibility

Refunds shall be considered strictly in accordance with UK law and only in the following circumstances:

Protermars Ltd has caused an unjustified and material delayto the project.
Materials have been installed contrary to the approved drawings or specifications.
Materials or colours installed are materially differentfrom those explicitly stated in the signed contract.
Serious defects in workmanship which cannot be remedied within a reasonable period.

Any refund granted may be partial, reflecting costs already incurred, including but not limited to design, manufacturing, logistics, and labour.

8. Non-Refundable Situations

Refunds will not be issued in the following circumstances:

Client change of mind after approval of drawings and specifications.
Dissatisfaction with designs or layouts approved in writing.
Natural or artistic variation in epoxy flooring finishes.
Delays caused by force majeure events, supplier delays, weather conditions, or Client-requested changes.
Work completed in compliance with the contract, drawings, and accepted industry standards.

9. Cancellation Policy

9.1 Cancellation after written approval of drawings and commencement of production is not permitted.

9.2 Any deposits paid at this stage are strictly non-refundable, as materials are manufactured exclusively for the Client.

10. Limitation of Liability

Protermars Ltd shall not be liable for indirect, consequential, or aesthetic dissatisfaction where services have been delivered in accordance with contractual obligations.

11. Governing Law

This Refund Policy shall be governed by and construed in accordance with the laws of England and Wales. Nothing in this policy affects the Client’s statutory rights.

Tissy Ltd – Terms & Conditions

1. Introduction

These Terms & Conditions (“T&Cs”) govern all contracts and agreements between Tissy Ltd (“Company”, “we”, “us”) and the Client (“Client”, “you”) in relation to the supply of installation services, including but not limited to:

Aluminium fences
Aluminium flooring
Railings
Epoxy and Metallic Art floor coatings

By signing a contract with Tissy Ltd, the Client agrees to be bound by these T&Cs and the accompanying Refund Policy, which form an integral part of the agreement.

2. Nature of Services

Protermars Ltd provides custom installation services only and does not sell pre-manufactured products.
Services are performed according to bespoke project specifications, approved in writing by the Client.
All materials are manufactured specifically for the Client after approval and cannot be reused, resold, or modified for another project.

3. Project Approval and Production

Clients will receive:
- Drawings, layouts, and designs
- Samples (if applicable)
- Technical specifications
Production and installation commence only after written approval of all drawings and specifications.
Production timelines are typically 4–6 weeks, subject to complexity and factory scheduling.

4. Payment Terms

A deposit of 30%–50% is payable upon contract signing.
The remaining 50%–70% balance is due within 7 days of project completion and after the snagging process.
Late payment constitutes a breach of contract.

5. Epoxy Floor and Artistic Finishes

Metallic Art Epoxy coatings are hand-applied on site, and final appearance may differ from initial drawings or samples.
Variations in colour, pattern, and effect are not considered defects and do not justify refunds, provided work meets professional and industry standards.

6. Refunds

Refunds are governed by the Refund Policy.
Eligible circumstances include:
- Unjustified delays by Protermars Ltd
- Installation of incorrect materials or colours
- Serious defects in workmanship
Refunds may be partial, depending on costs already incurred.

7. Cancellations

Cancellation is not permitted after written approval of drawings and commencement of production.
Deposits are non-refundable once production starts.

8. Liability

Protermars Ltd is not liable for indirect, consequential, or aesthetic dissatisfaction where services have been provided in accordance with the contract.
Liability is limited to direct damages proven to result from negligence, breach of contract, or failure to meet specifications.

9. Force Majeure

Protermars Ltd is not liable for delays or failures due to events beyond its control, including but not limited to:
- Natural disasters
- Factory or supplier delays
- Weather conditions
- Client-requested changes

10. Governing Law

These T&Cs are governed by the laws of England and Wales.
Nothing in these T&Cs affects your statutory rights as a consumer or business entity.
